1. Acceptance of Terms & General Disclaimer
Welcome to ParkPulse (hereinafter referred to as "the App", "we", "us", or "our"). By accessing or using our application, dashboard website, backend endpoint loops, or purchasing an access pass, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, please do not use our services.
Nature of the Service: ParkPulse provides aggregated crowd data analysis, machine learning predictive wait time trajectories, and metric comparative assessments for popular theme park attractions.
Predictive Calculations Disclaimer: All analytical metrics—including but not limited to "Expected Wait" times, and indicators showing whether an active line is shorter or longer than usual—are algorithmic estimations generated via our private statistical modelling. Physical theme park gate metrics are highly fluid and subject to immediate shifts based on surprise crowding surges, unexpected maintenance disruptions, inclement weather, staffing modifications, priority fast-pass distributions, or internal security protocols.
No Guarantees: We make absolute no warranty or guarantee that our predictive estimates will perfectly match actual physical queues inside the resorts. You explicitly acknowledge that you use our mathematical calculations strictly at your own discretion and logistical risk.
2. Intellectual Property & Third-Party Affiliation Safeguards
Independent Operation: ParkPulse is an entirely independent consumer analytics app.
Independent Status Notice: The App is NOT affiliated with, authorised by, sponsored by, endorsed by, or in any way officially connected to any theme park operator, resort management company, or corporation, including but not limited to Comcast Corporation, NBCUniversal, SeaWorld Parks & Entertainment, Merlin Entertainments, or The Walt Disney Company, and all of their respective parent entities, subsidiaries, or domestic resorts.
Trademarks & Nominative Fair Use: Any trademarked terminology, park names (such as "Magic Kingdom" or "Universal Studios"), designated land names, or individual ride and attraction titles utilised throughout our software canvas are the exclusive registered property of their respective legal owners. Our usage of these names is strictly descriptive to provide essential geographical context to our users under standard nominative fair use principles. We do not claim any ownership, rights, or copyright over third-party assets or data signatures.
3. Accounts, Eligibility & Age Gates
Eligibility Requirement: You must be at least 18 years of age to register an account profile or utilise our software dashboard. By signing in, you represent and warrant that you meet this minimum age barrier.
Authentication Flows: Accessing pro dashboard layers requires authentication tokens handled securely via our third-party provider, Clerk.
Security Responsibility: You are solely responsible for maintaining the confidentiality of your active session credentials. Any account updates or token usage originating from your personal login terminal are your sole liability.
4. Fees, Pass Purchases, and Refund Policy
Premium Access Passes: Specific historical chart curves, full dashboard indexing, and advanced modelling require a premium access pass (such as a "1-Day Pass" or "7-Day Pass") handled through our billing provider, Stripe.
Deterministic Expiration: Your pass access duration is automatically bound to specific timestamps verified through Clerk user metadata fields. Upon chronological expiration of your chosen pass window, your platform permissions will safely return to the standard tier.
Strict No-Refund Policy: Because our optimisation calculations deliver immediate digital assets upon payment unlock verification, all pass purchases are strictly final, non-cancellable, and non-refundable. We do not issue partial refunds, extensions, or credits due to ride breakdowns, park closures, rainy conditions, travel delays, or vacation planning alterations.
5. Prohibited Conduct and System Misuse
No Automated Scraping: You are strictly forbidden from executing automated web scripts, scraping loops, queries, bots, or continuous automated calls targeting our system paths.
Usage Limits: Data served through the App is intended exclusively for live, personal, non-commercial use on individual mobile screens or desktop browsers while navigating physical park environments.
No Reverse Engineering: Any attempt to reverse engineer, systematically clone, harvest endpoints, or build competing crowd diagnostic indexes utilising our structural output data streams will result in immediate permanent account termination, configuration bans, and potential legal action for intellectual property infringement.
6. Limitation of Liability
Scope of Exclusion: To the absolute maximum extent permitted under applicable legislation, ParkPulse and its primary developers, shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages.
Example Exemptions: We are explicitly not responsible or legally liable for lost vacation days, missed reservations, restaurant cancellation charges, emotional stress, physical fatigue, or financial costs sustained as a result of trusting analytical approximations served by the App.
Financial Liability Cap: In all occurrences where a legal jurisdiction overrides liability exemptions, our total absolute aggregate liability to you for any verified claims arising out of these Terms shall never exceed the exact total you spent on active data passes within the App during the thirty (30) days preceding the filing event.
7. Modifications and Severability
Right to Amend: We reserve the uninhibited right to change, recalibrate, patch backend calculations, adapt layouts, or adjust pricing schemes inside the platform at any time.
Severability Clause: If any section, clause, or line of this text is found by an official court of law to be unenforceable or legally invalid, that specific portion shall be limited or severed to the minimal necessary degree, and all remaining structural parts of these Terms shall remain fully enforceable and active.

Wait Time Telemetry: Foundational park telemetry, attraction operating statuses, and raw standby wait times are provided by the ThemeParks.wiki API. We are deeply grateful to their open-source community for maintaining this data infrastructure.
